Good luck...If you do not stand up for yourself who will? Our government is out of control and out of touch....President Obama has talked tough about the need to shed wasteful spending. But will he practice what he preaches? His one-time rival, Sen. John McCain, brought up a pricey presidential project that seems a bit unnecessary — a fleet of 28 new Marine One helicopters that will cost taxpayers around $11.2 billion. Only by direct action can citizens get change that we can afford...
Lets take up the idea of money. Governments such as local towns and townships especially here in Pa have limited budgets. Money is always their weakest link. It is this link that is their Achilles heal. Always focus on their costs and in any dispute with them always tailor your actions to make all interactions with so that their meter is ticking.
If you want to start the legal meter ticking think about using this tack. When you have a dispute with the municipality contact the municipalities solicitor in writing. The lawyers usually charge by the hour. They call this billing hours. A simple letter may cost you half a buck. But when the attorney gets it. It costs them in some cases hundreds of dollars.
Why? Because they can not just trash the letter. They read it and file it.
Any notice of a problem or injustice will present dilemmas and risks for the community that lawyers have a responsibility to address with their clients. This all makes the meter start ticking.....
Here is a list of possible subjects that can be added to a letter that will result in homework for the lawyer and get the meter ticking..... Remember one letter one action. Do not list all your grievances in a single letter. Use multiple letters.
1) Tell the attorney you do not trust an official..Pick one that you have a grip with and put the official on notice that he is not to come onto your private property... If he does he will be prosecuted for trespass.
2)Send an email to the municipality. Refer to that email in a letter to the attorney. Let him seek that email from the municipality to discover what the letter is about. This requires time and a web search. The email will likely be considered spam. This makes its retrieval difficult and time consuming. Again... this is homework... And very costly....
3) Send a letter to the attorney and ask for information. A great piece of information is simply who is the municipalities insurance carrier and what is their policy number.
4)You have a tool box.... It has many tools. Consider weed laws. Does the municipality have a park? Are there noxious weeds there such as poison ivy and multi flora rose there? Write the cities attorney a letter and detail that a municipality has a noxious weed such as poison ivy in a park. Give the lawyer notice of the weeds presence and contact the insurance company about it as well. Suggest that if the problem is not corrected, their could be liability issues. If a child suffers an allergic reaction to the poison ivy, there could be a possible claim. This get the meters spinning.
5) Start a petition....Add a notice to the petition that says....we the following give notice for all officials to stay off our properties....along with other issues that are important to you. Copy and submit the petition early and often.. Each new signature is a opportunity to resubmit the petition. Of course to the towns attorney. It is your right to submit petitions.... You are not limited to how, to whom you submit it to, and how many times it is updated!! These little items cost time and billing hours to mount.
6) When you go into the municipal building always take a video camera. Down load the video on YouTube. Whether is it good or bad is not important. Send notice that this video has been downloaded and send a link to the attorney for the township.... Keep them informed....It is again just billing hours. Keep the meter ticking. When you find a problem that is caused by the municipality video it. Post it. Here is someone video showing a municipalities actions....
How to protect Your Property from Eminent Domain...
Eminent domain is the power possessed by the state over all property within the state, specifically its power to appropriate property for a public use. In some jurisdictions, the state delegates eminent domain power to certain public and private companies, typically utilities, such that they can bring eminent domain actions to run telephone, power, water, or gas lines. Under the Fifth Amendment to the Constitution, the owner of any appropriated land is entitled to reasonable compensation, usually defined as the fair market value of the property. Proceedings to take land under eminent domain are typically referred to as "condemnation" proceedings.
Fair market value is a weak link for the taking authority. Here is one suggestions that I have for you to consider...
Make the value and cost of the taking high for the municipality....
This might be done by simple leases that you write. You can have leases in your office for business cards. In our shop we could charge $1 a year for our subcontractors to place business cards that can be picked up by our customers. If there is a lease to a property, each lessee's lease must be included in the proceedings. Submit a copy of the names of lessors that need to be served with legal notices. One lease is easy to condemn ...100 is a lot of legal work.... Make your property a legal black hole.......
Enhance the value of your property..... If you have Indian artifacts... allow hunting them for a fee. We charge $75 day for field walking... $125 for digging rights for a day for each 2ft x 2 ft hole that is excavated by arrowhead hunters. This establishes a value to your resource. Join Your Property to our Arrowhead Hunting Club. Make sure that you pay taxes on this income.... It is proof that there is a valuable resource.... If the government takes your property and there is oil on it, they must pay for the oil reserves. If there are archaeological resources they should have to pay for them as well.......

Protect your property and start a balloon port or a helicopter port.. This is simply an airport. It can be obtained by a filing out a simple one page FFA application. I have 10 airports... Why... you become the air traffic controller over your air space. You can use this to stop landfills from being sited in areas close to you property. Landfills could interfer with you air rights because they attract sea gulls... many states require a one mile set back from airports for siting landfills. This protects your air rights. This can also stop building of windfarms next to your property. Turbines produce wind wakes and wind vortexes which can be directed onto your airspace. If they use your airspace for the turbines discharge, you may be able to get a court injunction to stop the turbines operation. Turbine companies do not own your air space. You need to have reasonable use of this air space so that is why you should file for he airport permit. It assigns that airspace to your airport. Additionally when the turbine company seeks insurance for its turbines... do you think they will obtain insurance if they site their turbines next to a balloon port?
Lease your property for open space uses. Leases can provide income. A property that has an income source will receive higher payments in an eminent domain taking than one without a lease. Besides each lease must be condemned as well. Think about a penalty clause in the lease so that if the property is condemned there is a penalty that must be paid to the lessee or even the penalty can be directed to your favorite charity!!!! Make breakage of the lease a poison pill that must be paid by the taking agency.
Put yourself in the position on the municipality. Would you take a property by eminent domain if you could not clearly estimate the cost of the taking??? This is part of your your security in the property. That.... it will be costly to take... Let the municipality make you an offer you can't refuse!!! A Good one!!! They may only have one way out after the taking... That is paying you. Remind them that you will not want the property back if they find out that its to costly... You will only want money....On one acre there are about 11,000 2 ft x 2ft squares that are dig able for arrowhead hunters... That could make your property worth about 1 million dollars or more an acre!!!
